JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 04-01-2023 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner has prayed for bail in a case registered for the offence punishable under sections 302, 201/34 of the Indian Penal Code.

As per allegation in the FIR, petitioner is husband of deceased (daughter of the informant) and he in connivance with his family members killed her and with a view of wipe off the evidence disappeared her dead body. On getting information by villagers, informant visited there and came to know that petitioner has secretly performed another marriage and killed his daughter.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.39204 of 2022(3) dt.04-01-2023 2/3 that he is innocent and has been falsely implicated in this case. Except suspicion, no material has come against the petitioner to implicate him in the present case. During investigation, police has found that several telephonic conversations with different persons were done by the mobile number of deceased as per Call Detail Report on 20.6.2019. Deceased was not living in her sasural at the time of alleged occurrence. As per para 9 of the petition that one Nawal Yadav, co-villager of the informant has filed a complaint case against two sons of the present informant and his daughter (deceased) and two other persons for alluring his wife for doing prostitution and for this Mufassil P.S. Case No. 260/2015 dt. 15.7.2021 was instituted in which police has submitted chargesheet after investigation. Petitioner is in custody since 21.01.2022.

The application for bail is opposed by learned APP for the State and learned counsel for the informant and submitted that petitioner is husband of the deceased and petitioner has killed his wife and thrown her dead body in the river Ganga as per his self confessional statement, (page 38 of the case diary). Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named
