Mr. Mohammed Arif ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 06-12-2022 The learned counsel for the petitioner seeks permission to withdraw the present anticipatory bail application with respect to petitioner no.1.

Permission is accorded.

Accordingly, instant petition is dismissed as withdrawn with respect to petitioner no.1.

Heard learned counsel for the petitioner and learned APP for the State.

The petitioner no.2 seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 324, 354(B), 307, 447, 448, 504 of the Indian Penal Code.

No.39078 of 2022(2) dt.06-12-2022 2/3 The learned counsel for the petitioner submits that the petitioner no.2 has antecedent of two cases and the informant alleges that he along with his father were going to Karbala fair where he saw a mob running towards them raining arrows on account of which, they tried to hide, but the mob reached there and Md. Yasin ordered to kill whereupon Md. Mangan shot arrow upon father of the informant hitting him in his rib cage on the left side. Further, Md. Abid injured Masudan by shooting arrow upon him. It is further alleged that father of the informant died during the course of treatment.

The learned counsel for the petitioner submits that the allegation of shooting the father of the informant by an arrow is against Md. Mangan, who has been permitted to withdraw the present anticipatory bail application. As far as the present petitioner is concerned, the allegation against him is general and omnibus in nature.

The learned Additional Public Prosecutor opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, is directed to be

No.39078 of 2022(2) dt.06-12-2022 3/3 released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bhargama P. S. Case No.224 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
