JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 20-05-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of anticipatory arises out of Dumraon P.S. Case No. 396 of 2015, disclosing offences under Sections 363,366A of the Indian Penal Code.

Considering the statement of the victim made under Section 164 of the Code of Criminal Procedure, I am not inclined to grant the petitioner privilege of anticipatory bail. In the said statement she has stated that the petitioner established physical relationship with her, who is apparently a minor studying in ClassVIIth. This application is, accordingly, rejected.

Petitioner is directed to surrender before the Court

below within four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit, without being prejudiced by rejection of present application for grant of anticipatory bail. (Chakradhari Sharan Singh, J) ArunKumar/- U
