The present application has been filed for modification of the order dated 04.05.2017, passed in CWJC No. 16895 of 2013 which was filed for a direction to the respondent authorities for removal of the encroachment from the land appertaining to Khata No.109, Survey Plot No. 349, situated in Thana No.1, Mauza-Dhaniyari, Circle-Belhar, District - Banka. In view of the submissions made by learned Counsel appearing on behalf of the State, the Writ application was dismissed as infructuous vide order dated 04.05.2017,

Patna High Court MJC No.2085 of 2017(4) dt.13-09-2017 2/2 though none had appeared on behalf of the petitioner. In view of this Court, this modification application is absolutely misconceived.

The modification application is, accordingly, disposed of with a liberty to the petitioner to take recourse to the appropriate remedy.
