2. The petitioner has preferred this application for grant of regular bail in connection with S.T. No. 487/24 arising out of Shambhuganj P.S. Case No. 246 of 2024 dated 28.08.2024 registered for the offences punishable u/ss 103(1) read with Section 3(5) of the B.N.S.

3. As per the prosecution case, the petitioner and the co-accused persons used to assault the informant's daughter with the intention to kill him. When the informant and his family members went to the house of the petitioner and he came to know that his daughter was killed by the accused persons.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has been made accused in this case because he is the husband of the deceased. The petitioner and the informant

Patna High Court CR. MISC. No.36286 of 2025(2) dt.06-08-2025 2/2 are the co-villagers and there was love affair between the informant's daughter and the petitioner. The informant's daughter was married to the petitioner with her consent. The petitioner has never demanded any dowry nor tortured the deceased and he has no concern with the alleged offence. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 29.08.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner and submitted that the petitioner is the husband of the deceased.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Banka in connection with S.T. No. 487/24 arising out of Shambhuganj P.S. Case No. 246 of 2024.

7. The application stands allowed.
