This application for grant of anticipatory bail arises out of Jokihat (Mahalgaon) P.S. Case No. 381 of 2014, disclosing offences under Sections 447, 448, 341, 323, 379, 380, 307, 354(B), 504, 506/34 of the Indian Penal Code. Learned counsel for the petitioners has submitted that similarly situated co-accused, Muzaffar has been granted anticipatory bail by this court vide order dated 16.02.2016 passed in Criminal Misc. No. 6994 of 2016 and the case of the present
Patna High Court Cr.Misc. No.18890 of 2016 (2) dt.06-05-2016 2/2 petitioners is identical to that of Md. Muzaffar. Considering the fact that co-accused has been granted anticipatory bail, this application is allowed. Let the petitioners, above-named, in the event of his arrest/surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M, Araria, in Jokihat (Mahalgaon) P.S. Case No. 381 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
This is subject to the condition that the petitioners shall present themselves before the police/court, as the case may be, as and when required and in the event of failure on their part to appear before the court on two consecutives occasions, their bail bonds shall be liable to be cancelled.
