The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 394, 506 of the Indian Penal Code.

The prosecution case in nutshell is that petitioner and other co-accused persons surrounded the informant and snatched Rs. 10,000/-(ten thousand) by showing pistol.

It is submitted by learned counsel for the

Patna High Court CR. MISC. No.39054 of 2022(3) dt.13-02-2023 2/3 petitioner that the petitioner is innocent and he has falsely been implicated in the present case. Petitioner has neither been arrested on spot nor any incriminating article has been recovered from his possession. The name of petitioner sprang up in the present case only on the basis of his criminal antecedents. Moreover, petitioner is languishing in judicial custody since 21.02.2022.

Learned APP appearing for the State has vehemently opposed the prayer for Bail and submitted that petitioner is named in the F.I.R.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Industrial Area P.S. Case No. 111 of 2020 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to
