JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-08-2019 Petitioners seek bail in anticipation of their arrest in connection with Araria (R.S.) P.S. Case No. 375 of 2016 registered for the offences punishable under Sections 341, 342, 323, 504, 506, 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
Prosecution story is that informant and others had gone for cremation and while they were returning the petitioners stopped their motorcycle and petitioner No.1 demanded money on the point of pistol as petrol tank had become empty and when informant raised protest against the accused the pistol was fired and later on they fled away on motorcycle.

No.34934 of 2019(3) dt.22-08-2019 2/2 Submission of learned counsel for the petitioners is that three cases have been lodged from the informant's side and from the petitioners' side also cases have been lodged against the informant and others, which fact has been stated on oath in paragraph-10 of the petition and this case is concocted one as there is enmity between the parties from before. Heard learned APP also.
In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria, in connection with Araria (R.S.) P.S. Case No. 375 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
