JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 25-05-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Chapra Town P.S. Case No. 2 of 2016 registered under Sections 341, 323, 379, 307 and 504/34 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that the petitioner is innocent and his name has been given in this case due to previous enmity as the wife of the petitioner has instituted Complaint Case No.1744 of 2011 in the court of Chief Judicial Magistrate, Chapra against the petitioner on 8th July, 2011. It is further submitted that even otherwise there is no allegation of assault against the petitioner and the allegation of taking away some money is ornamental in nature.

Patna High Court Cr.Misc. No.21333 of 2016 (2) dt.25-05-2016 2/2 Learned counsel for the State has opposed the application for grant of pre-arrest bail.

Regard being had to the facts and circumstances of the, in the event of arrest or surrender in the court below within six weeks from today, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Town P.S.Case No.2 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
