JUSTICE SANDEEP KUMAR ORAL ORDER 05-07-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with S.T Case No. 485 of 2022 (arising out of Sohsarai P.S. Case No. 259/2019) registered for the offence punishable under Sections 147, 148, 149, 448, 302, 379, 504 of the Indian Penal Code and section 27 of the Arms Act.

As per the F.I.R., the allegation against the petitioner is that he has fired indiscriminately after the co-accused Nitish Kumar shot the deceased. The petitioner is in custody since 05.05.2022.

It is submitted by learned counsel for the petitioner that the firing made by the petitioner did not hit the deceased as the informant has not stated anything about the injury caused by

In a occurrence where a person shoots the victim and another person starts firing, it is very difficult for any person to see and assign a particular role to one of the criminals and the petitioner cannot take the benefit of the same. In view of the above, I am not inclined to grant bail to the petitioner. Accordingly, this application is dismissed.
