JUSTICE MOHIT KUMAR SHAH ORAL ORDER 06-09-2021 The instant case has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

The present petition has been filed for directing the respondent no. 2 i.e the District Level Selection Committee,

headed by the Collector, Muzaffarpur, to select the petitioner and grant him Public Distribution System license, in place of the respondent no. 6.

At the outset, the learned counsel for the petitioner seeks liberty to approach the Divisional Commissioner, Muzaffarpur by filing appropriate appeal under Rule 32 (vi) of the Bihar Targeted P.D.S. Control (Order), 2016. Liberty so sought is granted.

Accordingly, the present writ petition stands disposed of with liberty to the petitioner to file appropriate appeal before the appellate authority and in case such an appeal is filed within a period of four weeks from today, the appellate authority shall consider the same on merits and dispose it off by a reasoned and a speaking order, in accordance with law, within a period of eight weeks, thereafter.
