The petitioner seeks bail in Bhagwanpur Police Station (for brevity PS) Case No 32 of 2019 instituted for the offence punishable under Sections 341, 386, 307/34 of Indian Penal Code and Section 27 of Arms Act.
The prosecution alleges that the petitioner, along with other co-accused persons, has demanded extortion from the informant and, thereafter, raided his house and resorted to indiscriminate firing.
Petitioner's counsel submits that in fact, the petitioner's mother and female members were assaulted and attempts were made to outrage their modesty on 15.02.2019
Patna High Court CR. MISC. No.36562 of 2020(3) dt.20-02-2021 2/2 itself and, therefore, the petitioner has falsely been implicated in this case. It is further submitted that the complaint in this regard has also been lodged as per Complaint Case No 523 of 2019. The petitioner is now in custody since 30.03.2020. Learned APP has opposed the prayer for bail. It is submitted that the case diary has been received. The informant side have suffered firearm injuries. The complaint, referred to by the petitioner's counsel, is dated 25.03.2019, i e, much later in time and, therefore, the plea of the instant case being the counterblast, is wholly misplaced.
Considering the submission of parties, this Court is not inclined to grant bail to the petitioner. Prayer is rejected. (Madhuresh Prasad, J) M.E.H./- U T
