JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER --------- 10-02-2015 Despite repeated calls, none appears on behalf of the petitioner in support of the present writ petition. The matter at issue is publication of panel of the candidates on the basis of their performance in the interview for allotment of retail outlet dealership of Bharat Petroleum corporation Limited at Berkap in the district of Rohtas.
Patna High Court CWJC No.18210 of 2009 (3) dt.10-02-2015 2/2 Mr.Sanjay Singh, learned counsel appearing on behalf of the respondent nos. 2 to 7, by referring to the averments made in the counter affidavit filed on behalf of the respondent nos. 2 to 5, submits that in view of subsequent development, the present matter has become infructuous. It is further submitted that the selection of the respondent no.8 for allotment of retail outlet dealership has been approved by the General Manager of the Corporation and accordingly, letter of intent in favour of the respondent no.8 was issued way back on 17.01.2013, but the petitioner has chosen not to challenge the aforesaid letter of intent dated 17.01.2013 in the present proceeding.
In view of the averments made in the aforesaid counter affidavit, which have not been controverted by the petitioner by filing any rejoinder affidavit, coupled with the fact that none has appeared on behalf of the petitioner in support of the present writ petition, it appears that the submission of learned counsel appearing on behalf of the respondent nos. 2 to 7 that the present writ petition has become infructuous, is correct. In the result, the writ petition has to fail and is, accordingly, dismissed.
