Mr.Rajendra Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-05-2019 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is in custody in connection with Sahajitpur P.S. Case No.32 of 2019 for the offences under Sections 420, 406, 467, 468 and 379 of the Indian Penal Code. Allegation against the petitioner is that at the relevant time he was Manager of Flour Mill and he has defalcated about Rs.10 lacs or its valuation of articles from the said Mill. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and he is in custody since 06.04.2019. Learned counsel further submits that in fact the petitioner has invested about Rs.6 lacs in the flour mill and the informant has denied to pay the same and in this regard a complaint petition has been filed by the informant.

Considering the aforesaid, the Court is inclined to grant bail to the petitioner. Let the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Vith, Chapra, in connection with Sahajitpur P.S. Case No.32 of 2019.
