The petitioners being the brother's wife and the sister of the husband of the victim are apprehending their arrest in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code. The accusation is of killing the daughter of the informant after about 13 years of the marriage by causing burnt injury.
It is submitted by learned counsel for the petitioners that husband of the victim has not been made accused. The victim died natural death and in order to put
Patna High Court Cr.Misc. No.8180 of 2015 (02) dt.26-02-2015 2/2 pressure for partition as per the wishes of the husband of the victim the present case has been lodged. The accusation is omnibus and general and during the initial level of the investigation the case has been found true under Section 306 of the IPC.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 117 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
