The petitioner seeks bail in Ghoshi (Okari) P.S. Case No. 458 of 2018, registered for the offence punishable under Section 366(A)/34 of the Indian Penal Code.
As per the prosecution case, informant's daughter along with her friend went to the market for purchasing some articles. At the same time, informant also went to the market and saw that both the girls were taken away by this petitioner on a vehicle. Both the girls are still traceless.
It is submitted that petitioner has been falsely implicated in this case. In fact, there is love affair between the informant's girl and her friend. Both the girls have solemnized marriage and are living in Saharsa.
Patna High Court CR. MISC. No.35567 of 2020(3) dt.29-01-2021 2/2 Learned APP however, vehemently opposed the prayer for bail and submitted that there is direct allegation of kidnapping the minor daughter of informant and the girl is still traceless.
Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected. However, the trial court is directed to conclude the trial as early as possible.
