JUSTICE RAMESH KUMAR DATTA) 19-02-2015 Learned counsel for the petitioners submits that the appeal stood dismissed because the peremptory order dated 28.3.2011 was partly complied within time by filing requisites for ordinary process on 4.4.2011 but inadvertently the requisites for registered cover notice were not filed.
On a consideration of the facts and circumstances of the case, LPA No. 528 of 2011 is directed to be restored to its original file subject to the condition that the order dated 28.3.2011 passed in the said LPA is complied within a period of two weeks from today.
