The petitioner has filed the instant application for grant of regular bail in connection with Sonbersa P.S. Case No. 36 of 2022 registered under sections 395, 397 of the Indian Penal Code and Section 27 of the Arms Act.

Prosecution case in nutshell is that the informant and his son went for purchasing articles for the purpose of marriage of his son, in the meantime, there were some unknown accused persons who snatched money from them and they also fired upon the informant and his son due to which they sustained injury.

He has falsely been implicated in this present case. The petitioner has not been put on T.I.P. and nothing incriminating article has been recovered from the possession of the petitioner. It is further submitted that the name of the petitioner came into light only on the basis of his self confessional statement. Petitioner is languishing in judicial custody since 23.03.2022. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Sonbersa P.S. Case No. 36 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M-VII, Sitamarhi.
