In this application for anticipatory bail the petitioners apprehend their arrest for the offences punishable under sections 366A/34 of the I.P.C.

Allegedly, the petitioners and other named in the FIR took away the sister of the informant with intent to marry her. Submission is of false implication and further that the victim has been examined under section 164 Cr.P.C. wherein she has not supported the allegation of kidnapping rather she has stated specifically that she went to the house of her Mousi and she was not kidnapped, vide Annexure-2, to which the learned A.P.P.

Patna High Court Cr.Misc. No.37440 of 2014 (2) dt.25-03-2015 2/2 does not oppose.

In the facts and circumstances as stated above, considering the statement of the victim recorded under section 164 Cr.P.C. the petitioners Sonu Sah @ Sonu Kumar Sah and Shyam Kumar @ Shyam Kumar Mandal, in case of their arrest or surrender within two months from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of. S.D.J.M. Bhagalpur in Pirpainty P.S. Case No. 115 of 2014, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
