The petitioner in the present case is seeking anticipatory bail in connection with Special Case No. 3029 of 2019 arising out of P.R.Alamganj P.S. Case No. 258 of 2019 registered for the offences punishable under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise (Amendment) Act. Learned counsel for the petitioner submits that on perusal of prosecution report it will appear that this petitioner was not residing in the house in question from where the illicit liquor has been recovered.

Learned counsel submits that the petitioner is a retired principal of a college and has no criminal antecedent.

No one has opposed the prayer of anticipatory bail of the petitioner.

In the given facts and circumstances of the case where the house in question was not in possession of the petitioner as he was living separately and further that he has no criminal antecedent, let the petitioner above named, in the event of his arrest or surrender within a period of four weeks from today in connection with Special Case No. 3029 of 2019 arising out of P.R.Alamganj P.S. Case No. 258 of 2019 be released on bail on furnishing of bail bond of Rs. 15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. i.e. (i) a condition that the person shall make himself available for interrogation by a police officer as and when required;

(ii) a condition that the person shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police
