JUSTICE SATYAVRAT VERMA ORAL ORDER 17-01-2022 The present petition has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

Heard learned counsel for the petitioner and learned APP Smt Asha Kumari for the State.

Petitioner seeks bail in connection with Saraiya P.S. Case no. 64 of 2021 registered for the offence punishable under section 414/34 of the Indian Penal Code read with sections 25(1-b)a, 26, 35 of the Arms Act and sections 20 and 22 of the NDPS Act.

Learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the FIR, it would manifest that as far as this petitioner is concerned allegation

No.47202 of 2021(2) dt.17-01-2022 2/3 against him is of recovery of one country made pistol and live cartridge from his waist and as far as allegation of recovery of Afim along with country made pistols are concerned that were recovered from other accused persons. Learned counsel submits that though allegation against this petitioner is only under the Arms Act but petitioner has antecedent of six cases as mentioned in para 3 of bail petition.

Learned APP opposes the prayer for bail.

Considering the facts that petitioner is in jail custody since 20.01.2021 and charge sheet has been submitted, the petitioner is directed to be released on bail on furnishing bail bonds of Rs 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judgecum- Special Judge, Muzaffrpur in Saraiya P.S. Case no. 64 of 2021 with conditions that one of the bailers shall be father of the petitioner and the petitioner will continue marking his attendance in concerned police station in between 25th -30th of every month commencing from January, 2022 till framing of the charge and the concerned police station on the last date of every month will submit a report to the learned court below that the petitioner is marking his attendance, in the event it is reported that the petitioner in any of the month in between the aforesaid

Patna High Court CR. MISC. No.47202 of 2021(2) dt.17-01-2022 3/3 date has not marked his attendance by the concerned police station, the learned court below shall forthwith cancel his bail bond.
