JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 08-02-2017 This is, in fact, second modification sought by the petitioner in the order dated 10.07.2015 passed in Cr. Misc. 23678 of 2015. It is stated that the total percentage of the defalcated money as directed under order dated 10.07.2015 have now been deposited. However, there was delay of few months in depositing the same.
By the present modification application extension of time has again been sought till 07.01.2017, as by the said time, the petitioner has already deposited the required percentage of the defalcated amount with the Bihar State Food and Civil Supplies Corporation ( for short 'the Corporation') as directed under the order granting bail. The counsel for the Corporation is not in a
Patna High Court Cr.Misc. No.48862 of 2016 (3) dt.08-02-2017 2 / 2 position to refute the same based on the instruction received from the Corporation. However, the petitioner has again sought modification in the order as he has delayed in payment of the amount as directed under order dated 10.07.2015. I am inclined to extend the time of deposit of the amount as per the order granting anticipatory bail till 07.01.2017 subject to the condition that the petitioner shall additionally deposit a sum of Rs. 50,000/- (Fifty thousand) with the Corporation in favour of the Corporation, Kaimur and present the receipt before the Court within 04 weeks. Within the same time, petitioner will also apply for confirmation of bail which shall be considered by the learned Court below in the light of the original order granting bail as well as the present order.
