The petitioner is in custody in connection with Bathnaha P.S. Case No. 61 of 2019 for the offences under Section 414 of the Indian Penal Code and Section 20, 22, 23 of N.D.P.S. Act.

Learned counsel for the petitioner submits that the petitioner four criminal antecedent and he is in custody since 15.02.2019. He further submits that allegation against this petitioner is that he was involved in theft of motorcycle and also in trade of Narcotics. He further submits that in the instant case 5 kg. Ganja was seized from the motorcycle and nothing was recovered from the conscious possession of the petitioner. Considering the fact that nothing was recovered from

No.35424 of 2019(2) dt.30-05-2019 2/2 the conscious possession of the petitioner, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Additional District Judge-I-cumSpecial Judge (NDPS) Act, Sitamarhi in connection with Bathnaha P.S. Case No. 61 of 2019.
