JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-03-2015 Heard learned counsel for the petitioner as well as leaned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Dhanaha P.S. Case No. 08 of 2014 registered under Section47(A) of the Excise Act. The petitioner is not named in the first information report but in course of investigation, it, came to light that the petitioner was owner of the seized motorcycle. The stand of the petitioner is that the seized motorcycle had already been sold by the petitioner to one Mangal Yadav but unfortunately, the ownership of the aforesaid motorcycle could not be transferred in the record of Transport

Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioner named above, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of the order in the court below, be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Dhanaha P.S. Case No. 08 of 2014 to the satisfaction of learned Additional Chief Judicial Magistrate, Bagaha, West Champaran, Bettiah subject to the conditions as laid down u/S 438(2) of the Cr. P.C.
