Having regard to the fact that the petitioner faces prosecution for offence under sections 366A and 379 of the Indian Penal Code and the involvement of the petitioner now has surfaced despite his being not named in the F.I.R., in 164 Cr.P.C. statement where the victim has not only made direct allegation against the petitioner of keeping in confinement against her wishes but his physically assaulting her, this Court keeping in view that the victim lady was already married to Pintu Yadav wound not find the petitioner to be entitled for grant of anticipatory bail. The prayer for anticipatory bail is, accordingly, rejected. Nothing said in this order, however, will come in the way of the petitioner if he surrenders and makes a prayer for regular bail.
