The petitioners apprehend their arrest in Bidupur P.S. Case No. 410 of 2014, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code and Section 27 of the Arms Act.
Ten persons are named in the FIR including the petitioners and it is alleged that the petitioners along with other accused persons made indiscriminate firing in which many persons sustained firearm injury out of which one Sujit Kumar who received firearm injury in his stomach died. Shri Rana Pratap Singh the learned Sr. Advocate appearing on behalf of the petitioners submitted that it is a case of land dispute and the petitioner Pranav Kumar @ Vikram Kumar is
Patna High Court Cr.Misc. No.7433 of 2015 (3) dt.02-03-2015 2/2 the informant of Biddupur P.S. Case No. 413 of 2014 and he has also sustained injury.
It appears that, of course, there is a land dispute between the parties and both the sides made allegation and counter allegation. One side have tried to grab the lands of other side, but since there is specific allegation that the petitioners and others made indiscriminate firing in which six persons are alleged to have received firearm injury and one person namely Sujit Kumar died.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
