JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date: 16-08-2017 Orders have been passed by the Sub-Divisional Officer, Biraul, Darbhanga in Case No.333/2001 under Section 133 of the Code of Criminal Procedure for removal of encroachment. It is stated that Circle Officer had submitted a report to the Sub-Divisional Officer on the basis of which, the Sub-Divisional Officer directed the Circle Officer to remove the encroachment, but the Circle Officer has not taken any action even though the petitioner submitted various applications and representations to the District Magistrate and the Circle Officer, as is evident from the documents filed, i.e. representations dated 10.10.2016 and 13.06.2017. Accordingly, the only grievance of the petitioner is that

Patna High Court CWJC No.11656 of 2017 dt.16-08-2017 2/2 encroachments identified and directed to be removed by the SubDivisional Officer way back in the year 2001 still continues and the Circle Officer and the District Magistrate have not taken any action. Keeping in view the aforesaid grievance of the petitioner, it is directed that on the petitioner filing a certified copy of the order along with relevant documents, respondent No.2 and 3 shall look into the grievance of the petitioner and proceed to remove the encroachment in accordance with law after hearing all concerned and complete proceedings within six months thereof.
