The petitioner is in custody in connection with Special Case No. 2647 of 2019 arising out of Naubatpur P.S. Case No. 154 of 2019 registered for the offence punishable under Sections 379/411 of the I.P.C. and Section 37 (b) (c) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Allegation against this petitioner is that he was involved in pick-pocketing and he was arrested at the spot. Learned counsel for the petitioner would submit that petitioner is in custody in this case since 12.03.2019.

Considering the facts that petitioner has no criminal

No.35347 of 2019(2) dt.29-05-2019 2/2 antecedent and he has remained in custody for more than 2 1⁄2 months and as yet he has not been on TIP, let the petitioner named above be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Special Judge, (Excise) Act, Patna in connection with Special Case No. 2647 of 2019 arising out of Naubatpur P.S.
