Patna High Court CWJC No. 376 of 2021 dt. 22-06-2021 2/3 "i. For a direction to the respondents to not to deploy the doctors posted in various medical colleges and hospitals, different hospitals, different public health centres etc in election duty as patrolling Magistrate for conducting the forth coming state in Bihar as per the directions enclosed in para 3.32 of the handbook of election officer issued by Election commission of India ,New Delhi and as per the directions enclosed in memo no. 464/Inst/2005/PLN-1 dated 13.04.2005 issued by the Election Commission of India under the signature of Under Secretary to the Election Commission of India whereby it has been specifically stated that no medical practioners (Doctors) shall be drafted for election duty at any point of time.
ii. For a direction to the Chief Election Officer, Bihar to act in consonance with the provisions of para 3.32 of the handbook of election officers issued by the Election Commission of India ,New Delhi and in consonance with the direction of Chief election Commissioner as enclosed in letter no.
464/Inst/2005/PLN-1 dated 13.04.2005 and 464/Inst/2008/EPS dated 26.12.2008 and abide by the decision of the commission which has decided that medical practioners (doctors) will not be requisitioned for deployment of election duty and further, issue a fresh notification exempting the medical practioners (Govt. Doctors) of all districts of Bihar from election duty.

Learned counsel for the petitioner, under instructions from the petitioner, seeks permission to withdraw the petition for the same having become infructuous. Permission granted.
