Ms. Namrata Mishra, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 22-08-2023 Heard learned counsel for the petitioner and learned counsel for the Bihar School Examination Board (hereinafter referred to as the 'Board').

2. Petitioner in the present case is seeking a writ in the nature of mandamus commanding the respondents to declare the result of his 1st Year Diploma in Elementary Education of the Session 2021-22.

3. The grievance of the petitioner is that he had appeared in the practical examination but the marks of the same was not sent to the Board due to human error.

4. Learned counsel for the petitioner submits that the

Patna High Court CWJC No.9173 of 2023(4) dt.22-08-2023 2/3 petitioner was wrongly shown absent and in this regard the representation submitted by the petitioner vide Annexure- '8' to the writ application remain unattended.

5. This Court vide order dated 11.07.2023 while granting time to the Board to file counter affidavit directed the Board to examine the matter and take an appropriate decision.

6. Now a counter affidavit has been filed. Paragraphs '17' and '18' of the counter affidavit read as under:- "17. That it is in view of the report submitted by the said five member committee, thereafter steps have taken in correcting the result of the candidates concerned pertaining to their said D.El.Ed. Examination. Accordingly the result of the petitioner's 1st year D.El.Ed. Face to face course examination Session 2021-23 for subject code F-7 (Int.) under Roll Code-71805, Roll No.-211076 has been directed to be corrected by awarding him 14 marks in his said subject; necessary order has further duly been passed vide order bearing T.T. Pre.356/2023 dated 14.08.2023 and sent to the agency concerned for preparing the corrected result pertaining to the present petitioner as well.

18. That it is humbly submitted that from the facts mentioned above it is apparent that due steps has already been taken in issuing the corrected result of the present petitioner redressing his grievance as raised before the Hon'ble Court."

7. Learned counsel for the Board submits that the

Patna High Court CWJC No.9173 of 2023(4) dt.22-08-2023 3/3 result of the petitioner shall be published within two weeks from today.

8. Having regard to the aforementioned stand of the Board and the submission that the result of the petitioner shall be published within two weeks, this writ application is being disposed of as having become infructuous.
