JUSTICE HARISH KUMAR ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 28-06-2024 The public interest litigation seeks to stall the construction of a sports building in the Pt. Deen Dayal Stadium, Gopalganj, which is attached to the V.M. Inter College. The writ petition seeks the authorities to take a policy decision; which the Hon'ble Supreme Court has, time and again held, is not within the ken of the jurisdiction under Article 226 of the Constitution of India.

2. We find absolutely no public interest in the litigation especially since, what is sought to be constructed is only a sports building, which is again in furtherance of the use of the playground to its full extent.

3. We dismiss the writ petition as misconceived and not maintainable.
