The petitioner seeks bail in connection with Sessions Trial No. 890 of 2024 arising out of Dobhi P.S. Case No. 79 of 2024 instituted for the offence under Section 365 of the Indian Penal Code (IPC) and charge sheet is submitted in this case under Section 302, 201 & 34 of the IPC. 3.

The prosecution case is that on 19.05.2024 at about 9:00 P.M., informant Rubi Devi's husband went missing after she called him for dinner, and his mobile was found switched off. Despite searches by her and the family, no trace of him could be found, leading to the present case.

It has been submitted on behalf of the petitioner

Patna High Court CR. MISC. No.36280 of 2025(3) dt.18-08-2025 2/3 that the petitioner is in custody since 22-05-2024. Petitioner bears no criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Petitioner is not named in the FIR. Name of the petitioner has surfaced in this case during investigation. Save and confessional statement of petitioner, there is no material against the petitioner.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. As per confessional statement of co-accused, it is revealed that petitioner had illicit relation with the wife of the deceased and in connivance with the wife of the deceased, petitioner has committed murder and threw his dead body covered in plastic bag in a well of the village.

Considering the aforesaid facts and circumstances of the case, nature and gravity of the offence and role of the petitioner, which is evident from the materials available on record, this Court is not inclined to grant bail to the petitioner. Prayer for grant of bail is rejected.

The Trial Court is directed to expedite the trial as
