JUSTICE PRABHAT KUMAR JHA ORAL ORDER 18-07-2016 Heard learned counsel for the petitioner, learned APP for the State as well as the learned counsel for the vigilance. The petitioner apprehends her arrest in Maheshkhut P.S. Case No. 12 of 2016 registered for the offences punishable under Sections 467, 468, 471, 420 and 120(B)/34 of the Indian Penal Code.

The petitioner was appointed as Shiksha Mitra on the basis of the certificate issued by Madhyamik Shisha Parishad, Delhi. The institute was not duly recognized by UGC. It is submitted that similarly situated co-accused Amit Kumar has already been enlarged on anticipatory bail vide order passed in Cr. Misc. No. 19257 of 2016 on 18.05.2016. The Petitioner was having no knowledge about non-recognition of the

Patna High Court Cr.Misc. No.19682 of 2016 (3) dt.18-07-2016 2/2 certificate.

Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that the petitioner is a lady and similarly situated co-accused has already been enlarged on anticipatory bail, the petitioner above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria in Maheshkhut P.S. Case No. 12 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to conditions as mentioned in Cr. Misc. No. 19257 of 2016.
