The petitioner, who has been made accused for offence under section 379 of the Indian Penal Code, having been not named in the First Information Report and his involvement only transpiring after 17 months, that too on the confessional statement of a co-accused would be entitled for privilege of anticipatory bail, especially when he has got no criminal antecedent. That being so, in the event of arrest or surrender within a period of four weeks from today the petitioner, Shyam Sundar Kumar @ Sonu Kumar, shall be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Barh, Patna in Barh P.S.Case No. 208/2011, subject to the conditions as laid down under section 438(2) Cr.P.C. surendra/- (Mihir Kumar Jha, J)
