JUSTICE SUDHIR SINGH ORAL ORDER 22-07-2015 The petitioner is apprehending his arrest in connection with Dumaria Ghat P.S. Case No. 101 of 2014 for the offences instituted under Sections 341, 323, 324, 307, 379, 504, 506/34 of the Indian Penal Code.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that there is a land dispute between the cousin brother of the informant and the petitioner. The accused has suspected that the informant is supporting his cousin brother in this regard, for which, accused person threatened the informant for dire consequence. It has been submitted on behalf of the petitioner that there is case and counter case.

From perusal of the impugned order it appears that

Patna High Court Cr.Misc. No.27908 of 2015 (2) dt.22-07-2015 2/2 the injury sustained on the part of victim, is simple in nature, hence no offence under Section 307 I.P.C. has been made out. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of arrest or surrender before the learned court below within a period of six weeks from today in connection with Dumaria Ghat P.S. Case No. 101 of 2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
