The petitioner nos. 2 and 3 apprehends their arrest in a case registered for the offences punishable under Sections 307, 379 and other allied sections of the Indian Penal Code. As per the prosecution case, petitioner no. 2 assaulted the wife of informant with Dabia and petitioner no. 3 assaulted the son of informant by iron rod.

It is submitted that due to land dispute between the parties with regard to ancestral property an altercation took place in which petitioners are alleged to have assaulted

Patna High Court CR. MISC. No.41457 of 2022(3) dt.29-09-2022 2/2 informant and family members. Injuries sustained by the injured are reported to be simple in nature. Petitioners claim clean antecedents.

Considering the facts aforesaid, the petitioner nos. 2 and 3 above-named, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Bakhtiyarpur P.S. Case No. 47 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
