JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Turkaulia (Banjaria) P.S. Case No. 265 of 2014 registered for the offences punishable under Sections 414/34 of the Indian Penal Code, Section 11 A, B, C, D, E, F, G, H, I, J, K of Cruelty to Animal Act, 1960 and Sections 47, 48, 49 of Transportation of Animal Rule, 1978.

From perusal of the first information report itself, I find that the cattle belonged to Taiyab Khan and so far as petitioner is concerned, it is alleged that he was owner of the vehicle in question.

Considering the aforesaid facts and circumstances as

No.7557 of 2015 (2) dt.26-02-2015 well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, East Champaran in Turkaulia (Banjaria) P.S. Case No. 265 of 2014 subject to condition as laid down under Section 438(2) of the Cr.P.C.
