JUSTICE DINESH KUMAR SINGH) 25-07-2019 It appears that earlier M.A. No. 86 of 2017 was filed by the appellant against the impugned judgment dated 8.4.2016 passed by the learned Principal Judge, Family Court, Jehanabad in Matrimonial Case No. 84 of 2012 whereby the Matrimonial Case filed with a prayer of the appellant for a decree of divorce for dissolution of marriage under Section 13(1-A)(i) of the Hindu Marriage Act, 1955 on the ground of non-resumption of cohabitation for more than one year of passing the decree of judicial separation was dismissed, but the aforesaid Miscellaneous Appeal was dismissed for non-compliance of the peremptory order dated 30.3.2018 passed by a Division Bench of this Court.
After some arguments, learned counsel for the
Patna High Court MA No.711 of 2018(4) dt.25-07-2019 2/2 appellant seeks permission to withdraw this appeal with a liberty to file an application for restoration of Misc. Appeal No. 86 of 2017.
Accordingly, the present appeal is permitted to be withdrawn with the aforesaid liberty.
I.A. No. 1 of 2019 The aforementioned I.A. has been filed for condonation of delay of about 2 years 3 months and 5 days in filing the present appeal.
Since this appeal, on the prayer of learned counsel for the appellant, has been permitted to be withdrawn, no order need be passed on the aforementioned I.A.
