====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 25-06-2025 Heard Mr. Aryan Singh, learned counsel appearing on behalf of the petitioners and Mr. Yogendra Kumar, learned APP for the State.

2. The petitioners seek pre-arrest bail in connection with Sindhugarh P.S. Case No. 6 of 2025 registered for the offence punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 329(4), 303(2), 109, 74, 76, 351(2)(3) and 352 of the B.N.S., 2023.

3. As per the allegation made in the F.I.R., the petitioners along with other accused persons entered into the house of the informant and assaulted the informant with a common intention to kill him.

4. Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.36053 of 2025(2) dt.25-06-2025 2/3 petitioners submitted that there is case and counter case arising out of the same incidence. A partition Suit No. 77 of 2011 is pending between the father of the petitioner and father-in-law of the informant. Both are agnates. Petitioners have clean antecedent.

5. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioners.

Having heard the rival submissions made on behalf of the parties, as well as, having perused the allegation made in the F.I.R., I find that the petitioners have informed that there is case and counter case between the parties and a Partition Suit is also pending that led to the alleged incidence in which both the parties entered into fierce fight and during the said course, petitioners in their self defence might have caused some injury on the person of the informant without any intention, the petitioners, above named, are directed to be released on prearrest bail, in the event of their arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Sherghati, Gaya in connection with Sindhugarh P.S. Case No. 6 of 2025, subject

Patna High Court CR. MISC. No.36053 of 2025(2) dt.25-06-2025 3/3 to the condition as laid down under Section 482(2) of the BNSS.

7. The District Court is directed to verify the criminal antecedent of the petitioners and if it is found that the petitioners are involved in some other cases as what has been stated in Para-3 of the bail petition, this order will automatically lose its force.

8. The bail application stands disposed of.
