Petitioner is apprehending his arrest in a complaint case in which processes have been directed to be issued after cognizance being taken for the offences punishable under Section 420 of the I.P.C.

One vehicle suspected to be stolen was recovered from the house of complainant leading to registration of the present complaint. The complainant claimed that the said vehicle was purchased from the petitioner. It is submitted by learned counsel for the petitioner that there is no proof that complainant purchased the said vehicle from the petitioner. Though the petitioner was made accused in Birpur P.S. Case No. 135 of 2011 in which he has been granted bail.

The aforesaid facts constitute ground for

Patna High Court Cr.Misc. No.14826 of 2015 (2) dt.13-04-2015 2/2 consideration of regular bail, if the petitioner surrenders within a period of six weeks and pray for regular bail in connection with Complaint Case No. 323C of 2011, pending in the Court of learned Judicial Magistrate, 1st Class, Birpur, Supaul. Accordingly the application is disposed off.
