2. The petitioner is in custody in connection with Alamnagar P.S Case No. 429 of 2024 registered for the offences punishable under Sections 103(1), 3(5) of the B.N.S 2023 and section 27 of the Arms Act.
3. As per First Information Report, petitioner along with co-accused have fired bullet on the father of the informant and due to injuries he died.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is further submitted that informant is not the eye witness of the alleged occurrence and informant has expressed only suspicion on the
Patna High Court CR. MISC. No.40620 of 2025(3) dt.20-08-2025 2/2 petitioner for committing the alleged occurrence. It is also submitted that petitioner is in judicial custody since 03.11.2024.
5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.
6. On perusal of the FIR, case diary and impugned order dated 19.03.2025, it appears that petitioner is named in FIR merely on the basis of suspicion as there was no eye witness of the alleged occurrence.
7. Considering the aforesaid facts and circumstances of the case, materials available on record and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned JM, 1st class, Udakishunganj, Madhepura in connection with Alamnagar P.S Case No. 429 of 2024.
