2. The petitioner seeks regular bail in connection with Raxaul P.S. Case no. 522 of 2025 registered for alleged offence under section 303(2) of B.N.S, 2023.

3. According to the prosecution case, when the informant came to Dr. Shaista Pravin Clinic for the treatment of his wife, he parked his Hero Glamour motorcycle bearing registration no. BR05T7469 in front of the clinic and when he returned, he saw his motorcycle has been stolen.

4. Learned counsel for the petitioner submits that the petitioner is innocent, committed no offence, and has been falsely implicated in the instant case due to ulterior motive. In fact, the petitioner has not been named in the FIR, however, his

Patna High Court CR. MISC. No.37858 of 2026(3) dt.21-07-2026 2/3 name transpired in this case on the basis of confessional statement of the co-accused, Munna Kumar. Save and except the confessional statement of co-accused, Munna Kumar, no cogent material has surfaced during course of investigation against the petitioner. He further submits that the petitioner has no criminal antecedent and no incriminating article has been recovered from the conscious possession of the petitioner. Further, there is no eye witness to the alleged theft of motorcycle suggesting the involvement of the petitioner in the alleged occurrence. Moreover the police has submitted charge sheet against the petitioner. He further submits that the petitioner is in custody since 16.01.2026. Hence, the petitioner may be granted the regular bail.

Learned A.P.P for the State vehemently opposed the prayer for bail application of the petitioner and submitted that the allegation against the petitioner has three criminal antecedents other than the present one which is evident from paragraph 3 of the bail application, so he does not deserve to be granted the privilege of regular bail.

6. Heard the parties and perused the records as well as the materials available on records.

7. Considering the facts and circumstances of the case

No.37858 of 2026(3) dt.21-07-2026 3/3 and also the fact that the nothing incriminating has been recovered from the possession of the petitioner and the name of the petitioner transpired in this case on the confessional statement of the co-accused, Munna Kumar as well as the period of custody is 16.01.2026 , let the petitioner, above named, in the event of his arrest or surrender within a period of four weeks from today, be released on regular bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M, East Champaran at Motihari, in connection with Raxaul P.S. Case no. 522 of 2025.
