JUSTICE SATYAVRAT VERMA ORAL ORDER 07-12-2022 Learned counsel for the petitioners, at the outset, seeks permission to withdraw the prayer for anticipatory bail with respect to petitioner no. 1, namely, Ranjeet Kumar @ Ranjeet Kumar Mukhiya.
Permission is accorded.
Heard learned counsel for the petitioners and learned A.P.P. for the State.
Let the defect(s), if any, be removed within a period of four weeks.
The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 342, 323, 324, 504, 506, 307 and 379/34 of the Indian Penal Code.
Patna High Court CR. MISC. No.39712 of 2022(2) dt.07-12-2022 2/3 Learned counsel for the petitioners submits that rest of the petitioners are persons with clean antecedent. The informant alleges that the accused persons including the petitioners were demanding extortion of Rs.5,000/- from him and on order of petitioner no. 2, accused Ranjeet Mukhiya assaulted by knife causing injury on his lips. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the present case. It is further submitted that specific allegation of assault is against Ranjeet Mukhiya by knife causing injury on lips though the injury is simple and as far as allegation of demand of extortion is alleged, the same is ornamental in nature. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Lakhnaur
