The petitioner seeks bail in connection with Bettiah (M) P.S. Case No. 10 of 2020, dated 06.01.2020, instituted for the offence under Section 382 of the Indian Penal Code.

An attempt allegedly was made by the

Patna High Court CR. MISC. No.36470 of 2020(2) dt.01-02-2021 2/3 petitioner to take away the mobile telephone of the brother of the informant. However, he was arrested by the members of the public and was thrashed brutally. Learned counsel for the petitioner submits that it was wrong assessment of the members of the public that he had attempted to snatch the mobile telephone from somebody. In fact, a simple dispute had taken place between the petitioner and the brother of the informant in which the petitioner was assaulted. Only to save those persons, who had assaulted the petitioner, from being prosecuted in any case, a preemptive action has been taken by the informant in the shape of the subject F.I.R.

The petitioner is stated to be in custody since 07.01.2020.

Regard being had to the nature of accusation against the petitioner and his period of custody, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the
