JUSTICE SUDHIR SINGH ORAL ORDER 27-06-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 323,504,120B and 366A of the Indian Penal Code.
Allegation against the petitioner is that she along with other accused kidnapped daughter of the complainant for the purpose of marriage with Pankaj Mistry.
It is submitted on behalf of the petitioner that she has got no criminal antecedent. The daughter of the complainant had love affair with one Pankaj Mistry, who happens to be the son of the petitioner. Petitioner has been made accused in the present case for the said reason. The alleged occurrence is said to have taken place on 11.9.2015 but the case was instituted on 15.9.2015. The delay has not been explained by the prosecution. The other coaccused have been granted bail vide Cr. Misc. no. 8499 of 2016. On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his/her arrest or surrender
Patna High Court Cr.Misc. No.21606 of 2016 (2) dt.27-06-2016 2/2 in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui, in connection with Jamui P.S. Case no. 263 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) sudip/- U T
