2. The defect is ignored.

3. Heard the learned counsel for the petitioner and learned APP for the State.

4. The petitioner seeks regular bail in connection with Akorhigola P.S. Case No. 148 of 2025 registered for the offence under Sections 303(2) & 318(4) of the Bharatiya Nyaya Sanhita, 2023.

5. As per the prosecution case, the allegation against the petitioner is that he replaced the informant's ATM card by deceit while the informant was withdrawing money from an SBI ATM and thereafter fraudulently withdrew Rs. 48,000/-. The petitioner has been identified from the CCTV footage, which is stated to have been corroborated by his confessional statement.

6. The petitioner is in custody since 30.10.2025 and has seven criminal antecedents (as stated in paragraph no. 3 of the bail petition). The allegations against the petitioner are serious and grave in nature. There exists prima facie material against the petitioner indicating his involvement in the commission of the offence.

7. Considering the nature and the gravity of the offence, this Court is not inclined to grant regular bail to the petitioner.

8. Accordingly, this application for regular bail stands dismissed.

9. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
