JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 353, 354, 379, 427, 504, 506/34 of the Indian Penal Code. The prosecution case is that the informant, being an Assistant in the office of Block Development Officer, Daraunda, was performing her official duty when the petitioner came and enquired about sanction of Indira Awas and thereafter abused and assaulted the informant and snatched her golden chain and mobile. It is submitted by the learned counsel for the petitioner that petitioner is a BPL card holder and Indira Awas was sanctioned to him for which two installments were paid to the petitioner but third installment was not paid and for sanctioning
Patna High Court Cr.Misc. No.19937 of 2016 (2) dt.05-05-2016 2/2 the third installment bribe was demanded and on refusal by the petitioner, the false accusation has been levelled. Statement has been in paragraph 3 of the petition that the petitioner has no criminal antecedent. It is further submitted that for the occurrence dated 21.12.2015 at 11 A.M. the FIR was registered on 21.12.2015 at 5 P.M.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Siwan in connection with Daraunda P.S. Case No. 325 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
