Admittedly, petitioners happen to be cousin brother-in-law of informant Kiran Devi. Though, partition has been alleged in the year 1988 but without any cogent and reliable evidence and that being so, petitioners have got their share.

Consequent thereupon, petitioners Wakil Rai, Ram Umesh Rai @ Ram Anish Rai each are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Sakra P.S. Case No.34 of 2013 in event of their arrest / surrender within four weeks in terms of condition so laid down Section 438(2) Cr.P.C (Aditya Kumar Trivedi, J.) PN/- U T
