Petitioner seeks bail in connection with Kesariya P.S. Case No. 280 of 2013 registered for the offence punishable under sections 328 and 395 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that the first information report has been lodged against unknown and petitioner has been implicated in this case on basis of confessional statement of the co-accused. Petitioner is in custody since 24.12.2018.

Learned Addl. P.P. appearing for the State opposes the prayer for bail.

Patna High Court CR. MISC. No.36248 of 2019(3) dt.04-09-2019 2/2 Considering the nature of allegations levelled, the materials available on record specially the criminal antecedent of this petitioner and the submissions advanced on behalf of the parties, this Court does not find it to be a fit case for grant of bail to the petitioner. The same is, therefore, rejected.

However, petitioner may renew his prayer for bail after framing charge.
