JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-06-2019 This is an application for grant of anticipatory bail in connection with Amarpur P.S. Case No. 547 of 2018, disclosing offences under Sections 364/ 34 of the Indian Penal Code. Allegation against the petitioner and other is of kidnapping the minor son of the informant.

Submission of the learned counsel for the petitioner is that though the name of the petitioner is in the F.I.R. along with other accused persons and also taken away the motorcycle. Further submission is that the statement of the victim under Section 164 of Cr.P.C. has been recorded, in which, he has not named the petitioner nor any allegation has levelled against the petitioner.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner,

No.39524 of 2019(2) dt.27-06-2019 2/2 above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Amarpur P.S.
